Terms of Service

Please read these terms carefully before using HostKonek services. By creating an account or using any HostKonek service, you agree to be bound by these terms.

1. Acceptance of Terms

By accessing or using any service provided by HostKonek ("Company", "we", "us"), including but not limited to our website at hostkonek.com, client portal, APIs, and any related services (collectively, the "Services"), you ("Customer", "you") acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and all applicable laws and regulations.

If you are entering into these Terms on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms, in which case "you" shall refer to such entity.

2. Description of Services

HostKonek provides a comprehensive suite of internet infrastructure and hosting services, including:

  • Shared Hosting — multi-tenant web hosting with cPanel/Plesk control panels, SSD storage, free SSL certificates, daily backups, and one-click application installers.
  • Virtual Private Servers (VPS) — isolated virtual environments with dedicated CPU, RAM, and NVMe storage; root/administrator access; choice of Linux or Windows operating systems.
  • Dedicated Servers — single-tenant bare-metal servers with full hardware resources, IPMI/KVM access, DDoS protection, and optional managed support.
  • Domain Registration & Management — domain name registration, transfers, WHOIS privacy protection, and DNS management with global anycast nameservers.
  • Cloud & Managed Services — auto-scaling cloud infrastructure, managed databases, CDN integration, load balancing, and DevOps consulting.
  • Email Hosting — business-class email with spam/virus filtering, webmail, IMAP/POP3/SMTP access, and custom domain support.

Service specifications, resource allocations, and features are defined on the individual product pages and in your order confirmation. We reserve the right to modify or discontinue any service with 30 days’ prior written notice.

3. Account Registration & Security

To use our Services you must create an account. You agree to:

  • Provide accurate, current, and complete registration information.
  • Maintain the security and confidentiality of your account credentials, including passwords and API keys.
  • Promptly notify HostKonek of any unauthorized access or security breach.
  • Accept full responsibility for all activities that occur under your account.

You must be at least 18 years of age (or the age of legal majority in your jurisdiction) to create an account. We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion.

4. Acceptable Use Policy

You agree to use HostKonek Services only for lawful purposes. The following activities are strictly prohibited:

  • Hosting, distributing, or linking to malware, viruses, trojans, ransomware, or any malicious code.
  • Sending unsolicited bulk email (spam), operating open relays, or engaging in email abuse.
  • Hosting phishing pages, fraud schemes, or any content designed to deceive or harm users.
  • Operating illegal gambling, unlicensed pharmaceutical, or controlled-substance websites.
  • Conducting network attacks such as DDoS, port scanning, or unauthorized penetration testing against any system.
  • Hosting content that infringes copyrights, trademarks, or other intellectual property rights.
  • Cryptocurrency mining or any resource-abusive process on shared hosting plans.
  • Excessive resource usage that degrades service for other customers on shared infrastructure.

Violation of this policy may result in immediate account suspension or termination without refund. We reserve the right to cooperate with law enforcement agencies as required.

5. Billing, Payments & Refunds

5.1 Payment Terms

Services are billed in advance on a recurring basis according to the billing cycle selected at purchase (monthly, quarterly, semi-annually, annually, biennially, or triennially). Payment is due on the date of invoice. We accept credit/debit cards, PayPal, and bank transfers.

5.2 Late Payments & Suspension

If payment is not received within 3 days of the due date, a reminder will be sent. Services may be suspended after 7 days of non-payment. Accounts with invoices overdue by more than 14 days may be terminated and all data permanently deleted after an additional 7-day grace period.

5.3 Refund Policy

New shared and VPS hosting accounts are eligible for a 30-day money-back guarantee. Dedicated servers, domain registrations, SSL certificates, and setup fees are non-refundable. Refund requests must be submitted via the client portal.

5.4 Price Changes

We may adjust pricing with at least 30 days’ advance notice before your next renewal date. You may cancel your service before the new pricing takes effect.

6. Service Level Agreement

HostKonek guarantees 99.9% network uptime for all hosting services, measured on a calendar-month basis. Full details, including credit calculations and exclusions, are available in our Service Level Agreement.

7. Intellectual Property

You retain all ownership rights to the content you host on HostKonek servers. By using our Services, you grant HostKonek a limited, non-exclusive license to store, transmit, cache, and display your content solely for the purpose of providing the Services.

All HostKonek trademarks, logos, website design, proprietary software, documentation, and marketing materials are the exclusive property of HostKonek and may not be reproduced, modified, or distributed without prior written consent.

8. Data Handling & Privacy

We process personal data in accordance with our Privacy Policy and applicable data protection regulations including GDPR and CCPA. Key data handling practices include:

  • Backups — daily automated backups retained for a minimum of 7 days (shared/VPS) or 3 days (dedicated). Backups are a courtesy service and not a substitute for your own backup strategy.
  • Encryption — data in transit is encrypted via TLS 1.2+. Data at rest is encrypted on managed storage platforms.
  • Data Location — servers are located in Tier III+ data centers. Data center locations are disclosed on order pages.
  • Data Portability — you may download a full backup of your account at any time via the control panel or by contacting support.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOSTKONEK AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

Our aggregate liability for any claims related to the Services shall not exceed the total amount paid by you to HostKonek during the twelve (12) months immediately preceding the event giving rise to the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless HostKonek and its affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content hosted on your account.

11. Termination

  • By Customer — You may cancel your services at any time through the client portal. Monthly services terminate at the end of the current billing period. Prepaid terms are non-refundable beyond the 30-day guarantee window.
  • By HostKonek — We may suspend or terminate your account immediately if you violate these Terms, the Acceptable Use Policy, or if required by law. We will provide 30 days’ notice for terminations without cause.
  • Effect of Termination — Upon termination, your right to access the Services ceases immediately. We will retain your data for 30 days post-termination to allow retrieval, after which it will be permanently deleted.

12. Dispute Resolution & Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to conflict of law principles. Any dispute arising under these Terms shall first be submitted to good-faith negotiation for a period of 30 days, followed by binding arbitration under the rules of the Philippine Dispute Resolution Center, Inc. (PDRCI). The seat of arbitration shall be Cebu City, Philippines.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email and/or a prominent notice in the client portal at least 30 days before they take effect. Continued use of the Services after the effective date constitutes acceptance of the revised Terms.
